Legislation Would Restore Guard-related Tax Deductions

A bipartisan bill introduced in Congress last week would restore tax deductions previously used by members of the National Guard and state defense forces.

The State and National Guard Fairness Act of 2020 (H.R. 6041) has the support of NGAUS. It was introduced by Rep. Filemon Vela, D-Texas, and Rep. Ron Wright, R-Texas.  

If passed, it would restore tax deductions for unreimbursed work expenses, such as travel costs and uniform purchases. These deductions were legal before 2018, when an overhaul of the tax code took place.

Wright said the legislation was a commonsense fix that would reinstate the tax deductions, allowing Guardsmen to serve without financial burden.

“Our servicemen and women of the National Guard and state defense forces risk their lives to ensure that we are safe here at home. Due to the recent change in our tax code, these men and women are now required to pay for the expenses they incur during their service, which can reach thousands of dollars, out of their own pocket,” said Wright.

Vela said members of the Guard and state defense force should not be burdened with additional expenses for their time of service.

“I consider it one of my highest responsibilities as a member of Congress to ensure that they are offered the necessary resources to continue their excellent record of service,” he said.
