Resolution:

Section XXX. Title 32 - State Active Duty Reimbursement
(a) Intent and Purpose:
(1) The purpose of this provision is to establish a mechanism for governors to utilize Title 32 status for National Guard members in support of Defense Support of Civil Authorities (DSCA) missions, while ensuring reimbursement of costs incurred by the United States Government.
(2) This provision allows governors the option to choose between Title 32 and traditional state active duty as provided for in state statute when responding to DSCA missions.

(b) Title 32 for State Active Duty:
(1) Section XXX of Chapter 7 of Title 32 of the United States Code, titled "State Active Duty Reimbursement," shall be added to govern the reimbursement process for DSCA missions.
(2) The new section shall outline the reimbursement requirements and procedures as specified in subsections (c) and (d) of this provision.

(c) Reimbursement Requirement:
(1) States utilizing National Guard members under Title 32 status for DSCA missions shall be responsible for reimbursing the United States Government for the costs incurred.
(2) Reimbursement amounts shall be calculated based on the current year pay and allowance tables applicable to the respective service component of the National Guard.
(3) In addition to the pay and allowances, reimbursement amounts shall also include factors compensating for retirement points awarded and the cost of health care coverage.
(4) The Secretary of Defense, in consultation with the Secretary of the Treasury, shall establish guidelines and procedures for determining the specific reimbursement amounts.

(d) Reimbursement Process:
(1) States shall submit reimbursement requests to the Secretary of Defense within a specified timeframe, as determined by the Secretary.
(2) The Secretary of Defense shall review the reimbursement requests, verify the accuracy of the submitted costs, and process the reimbursements in a timely manner.
(3) The Secretary of Defense may establish reporting requirements to monitor the utilization of Title 32 status and ensure transparency and accountability in the reimbursement process.

(e) Flexibility and Impact on Existing Provisions:
(1) This provision does not mandate the use of Title 32 status for all DSCA missions and allows governors the discretion to utilize traditional state active duty, as provided for in state statute.
(2) The addition of Section XXX, "State Active Duty Reimbursement," to Chapter 7 of Title 32 shall not impact existing provisions within Title 32 or any other applicable federal laws or regulations, except as specifically outlined in this provision.
