Enact laws to provide pre-mobilization TRICARE benefits and post Transitional Assistance Management Program(TAMP) benefits upon deactivation to members of the Guard mobilized under Title 10 Section 12304b
Recommendation Information

1. Background:
As currently written, the various mobilization authorities under Title 10 United States Code have significant differences in benefits and entitlements that a member may receive. For example, under 12304b a member does not have access to TRICARE prior to their activation nor does it provide TRICARE Transitional Assistance Management Program (TAMP) upon deactivation. Additionally, 12304b does not provide credit for post-9/11 GI Bill benefits, reduced age for retirement, federal civilian differential pay, and several other benefits that are provided under other mobilization authorities. This disparity between benefits based on mobilization authority negatively affects every member of the National Guard. In order for these disparities to be rectified, Congress must modify Title 10 United States Code.

3. Recommendation:
It is the recommendation of NGAUS and the National Guard Bureau, the Department of Defense that the Congress of the United States modify Title 10 of the United States Code to align benefits and entitlements for members involuntarily ordered to active duty to be the same regardless of what authority is being used for mobilization.
