Develop legislation that eases restrictions on the use of USC Chapter 32 Section 502(f) status by the Secretary of Defense during natural or man-made disasters, and allows expeditious and direct funding to affected states and Emergency Management Assistance Compact providers.
Recommendation Information
Under current Stafford Act procedures it may take 2 years or longer for affected states to be reimbursed by Federal Emergency Management Administration who then reimburse supporting states who provided Emergency Management Assistance Compact forces. Further, the latest Department of Defense policy under Department of Defense Instruction 3025.22 makes it virtually impossible for states to respond in a federal pay status but still fall under the control of their respective Governors (T32 502.f.2).

The dual impacts of the restrictive Department of Defense policy on T32 502.f.2 and the inefficiency of Stafford Act reimbursement process could result in states unwilling or unable to provide Emergency Management Assistance Compact forces due to fiscal constraints within their state at the time of a catastrophic disaster.

NGB RECOMMENDATION: No Requirement. Current legislation and subsequent policies are non-restrictive and adhere to the GRM process for best sourcing solutions. Subsequent reimbursement allocations are tied to FY appropriations; these can take time to properly adjudicate to ensure fiduciary responsibility.
