Proposal Statement
Authorize retention bonuses for officers as a force management tool including those who have already received a bonus and restore eligibility, particularly for cyber operations officers.

Legislative Objective
NGAUS recommends that Congress include a provision in the Fiscal Year 2027 National Defense Authorization Act (NDAA) amending the applicable provisions of Title 10, United States Code, to address the prior enlisted bonus bar for non-medical officers. Two legislative remedies are proposed, in order of preference:
Option 1 (Preferred): Authorize Repayment to Restore Eligibility
Amend the law to permit non-medical officers who previously received an enlisted bonus to repay the proportional outstanding value of that bonus — or the full bonus amount — in exchange for restoration of eligibility to receive an officer retention bonus. This approach:
■ Respects the original intent of the enlisted bonus contract while providing a fair path to officer retention eligibility.
■ Is revenue-neutral or potentially cost-positive to the government when the repaid bonus amount is weighed against the cost of recruiting and training a replacement officer.
■ Creates a voluntary mechanism — officers who do not wish to repay are not compelled to do so.
■ Aligns with common-sense financial principles already embedded in other military bonus recoupment frameworks.
