Proposal Statement
Amend title 10, United States Code, to provide for retroactive calculation of active duty or active service performed as a member of the Ready Reserve to reduce the eligibility age for receipt of retired pay for non-regular service from January 28, 2008, to the start of combat operations in Afghanistan, October 7, 2001.
Recommendation Information
Why do we need this legislation? This legislation is important for members of the National Guard because:
When it comes to the age a service member will be eligible to receive their military pension, there is a huge difference between the active component and the reserve component. An active duty service member with at least 20 years of service receives their pension immediately upon retirement. Often times these service members are less than 40 years old. Meanwhile a reservist is not eligible to receive their military pension until age 60. At a minimum, we should enact this legislation to recognize the sacrifice and service of the reservists who deployed since the start of combat operations in Afghanistan. Even after passing this legislation, a reservist who deployed 10 times for ten years during this time, would still wait ten years more than their active duty counterparts who may not have ever deployed during their 20 year career.
2019 legislation for this issue is H.R. 620.
