Providing Maternity/Paternity Leave Policy for Reserve Component servicemembers equal to the current 12 weeks paid leave for Active Component servicemembers.
Recommendation Information
Engage the Unified Legislation and Budgeting (ULB) process to amend 37 U.S.C. § 206(a) to authorize pay and credit for birth/adoption-connected absences for qualified Reserve Component (RC) and National Guard (NG) members in inactive duty training (IDT) status.

Under Section 521 of the 2017 National Defense Authorization Act (NDAA), “Matters Relating to Provision of Leave for Members of the Armed Forces, Including Prohibition on Leave Not Expressly Authorized by Law,” qualified AC/AD personnel are provided six weeks of leave connected with a birth/adoption event. Section 521 expressly limited eligibility for birth/adoption-connected leave to AC personnel and AD-RC personnel subject to an active duty recall or mobilization order in excess of 12 months, and excludes NG members in IDT status from its ambit.

To foster an organizational environment in which our NG members in IDT status feel valued, and to ensure that the NG remains a competitive career option for a broader swath of the communities we serve, the NG must continuously strive, whenever possible, to provide quality of life enhancing benefits that are comparable to the AC. In this regard, a ULB action should be initiated to amend 37 U.S.C. § 206(a) to authorize pay and credit for 12 consecutive IDTs for qualified M-Day personnel.
