Amending the law to allow members of the National Guard, retirees, their accompanied dependents and widows of retirees, to travel outside of the United States on a space available basis on military aircraft.
Recommendation Information
The NDAA for Fiscal Year 2013 established in law eligibility for serving and retired members of the Reserve Component to travel on military aircraft as an eligible category subject to the Secretary of Defense filing a future report with Congress on the law's implementation with the understanding that the Secretary would not in bad faith negate the hard win benefit strenuously opposed by DoD staff. However, within a year of enactment the Secretary in seeming bad faith filed a report that prohibited fully expanding the subject travel benefit for the Reserve Component by arbitrarily and without a rational basis excluding all travel outside of the United States while allowing all other eligible categories to enjoy that benefit subject to security and logistical restrictions.

Eliminate the Secretary of Defense's discretionary veto over the full statutory eligibility of National Guard members, retirees and their accompanied dependents, and widows of retirees, that prohibits that category from traveling outside of the United States on a space available basis on military aircraft.
