Proposal Statement
Change existing federal law so that Guard members who are injured during state duty status(SAD) activation receive no fewer benefits than had they been injured during federal duty status
Recommendation Information
This proposal seeks to change current federal law so that Guard personnel who are injured during state duty activation receive no fewer benefits than had they been injured during federal status duty. Such benefits and services would include, but not be limited to:
--medical retirement benefits (compensation)
--medical care coverage at least equal to the Tricare/VA coverage they would receive from the duty related medical discharge
--state incapacitation pay for Guardsmen who are unable to perform their previously held job(s) or drill due to a state duty related injury/ies
--education/vocational rehabilitation benefits for those Guardsmen who have lost their jobs as a result of state duty related injury/ies
employment assistance/caretaker allowance for spouses of Guardsmen severely incapacitated as a result of state duty related injury/ies
