Proposal Statement
Pursue measures to ensure that Soldiers and Airmen on State Active Duty orders are not penalized in Retirement Point credit or benefits due to activation during a declared state emergency in a non-federalized status.
Recommendation Information
1. Develop a Waiver Authority for Federal Recognition. Service on SAD orders in excess of 30 days in a fiscal year could earn pro-rated retirement points toward a good year. e.g. For every 30 consecutive SAD days = earn 15 pts (similar to how active duty pts are awarded)
2. Develop legislation to authorize partial or full retirement point accrual for extended SAD period
Similar to how Title 32 or full-time National Guard Duty is counted. Model after special congressional actions that retroactively credited service during COVID missions.
3. Develop Constructive Service Credit, Constructive credit is already granted in some rare cases
-Request a narrow policy change allowing constructive credit only when SAD exceeds 60+ days and replaces standard drills/AT that year.
