Remove restrictions on the transfer of officers between the active and inactive National Guard.
Recommendation Information
Request for a change in law to permanently remove the restrictions on the transfer of officers and warrant officers between the active and inactive National Guard. Currently 32 USC 303 allows for only Army and Air National Guard enlisted members transfer to and from active and inactive statuses using the Inactive National Guard Program. NDAA 2014 Section 512 (Public Law 113-66) allowed Army and Air National Guard officers (including warrant officers) to transfer to and from active and inactive statuses through 31 December 2016. NDAA 2017 Section 514 (Public Law 114-328) extended that through 31 December 2019.
Without the ability to utilize the Inactive National Guard Program for officers, Army and Air National Guard officers either separate from service or transfer to an inactive status within another component in their respective service. The National Guard can better manage talent and retain its force with the use of the Inactive National Guard.
