In regard to Title 38, Part III, Chapter 43, specifically 4312- Reemployment rights of person who serve in the uniformed services. This new resolution proposal will address the following problem with USERRA law: Spouses are not covered for reemployment rights when their Service Member is absent by reason of service in the uniformed services. The proposed solution: Insert into Title 38, Part III Chapter 4312 (a): Subject to subsections (b), (c), and (d) and to section 4304, “any person and spouse" whose absence from a position of employment is necessitated by reason of service in the uniformed services shall be entitled to the reemployment rights and benefits and other employment benefits of this chapter.
