Provide Army/Air Line of Duty (LOD) coverage for Soldiers/Airmen who were physically injured or disabled as a result of state active duty
Recommendation Information
State benefits vary from state to state; most states provide a workers compensation for Soldiers/Airmen who are injured or disabled as a result of state active duty. Severe injuries currently result in non-duty related discharges.
This resolution directs expansion of Line of Duty (LOD) coverage by the Department of Defense to cover members of the Army or Air who are physically injured or disabled as a result of state active duty.
Upon an emergency declaration by the state governor; members of the National Guard who sustain injuries that prevent them from continued service and potential loss of benefits would be afforded, line of duty injuries as if they were in a military status with a valid line of duty (LOD) finding.
Members of the National Guard who sustain injuries on state active duty are eligible to receive hospital care and medical services from the Department of Veterans' Affairs (VA). If applicable, the VA provide reimbursement for hospital care and/or medical services to such members.
