Provide for Post 911 GI Bill benefits and Training and Rehab benefit protections as prescribed in Title 38 USC for mobilizations and activations under Title 10 Sections 12304a/b
Recommendation Information
Currently, service members mobilized or activated under the following authorities are not granted important Title 38 benefits that are provided under 12302 (Involuntary Mobilization):
12304b (Involuntary Mobilization - pre-planned)
12304a (Involuntary Mobilization - Fed DSCA)
Service members and their families should receive the same benefits regardless of mobilization authority. This is especially critical as many service members from the same unit will deploy for the same tasking under different mobilization/activation authorities. The specific Title 38 USC benefits required are:
38 USC 3301 - Post 911 GI Bill
38 USC 3103 - Training and Rehabilitation benefit protections
12304b (Involuntary Mobilization - pre-planned)
12304a (Involuntary Mobilization - Fed DSCA)
