Provide Regional Area Defense Counsel (ADC) Positions to Represent Air National Guardsmen
Recommendation Information
The creation of regional Area Defense Counsel (ADC) positions consisting of legal officers, judge advocates (JAG), and paralegals to represent Title 32 Airmen’s defense needs. Currently, defense duties are assumed by JAGs in command-advising positions either by dedicating one of the command JAG positions to defense work or by bouncing defense duties between the various command-advising JAGs. Having dedicated JAG positions with separate chains of command for defense matters would avoid these situations and provide the best representation for Title 32 Airmen. The Army National Guard has created regional Trial Defense Services (TDS) offices providing defense representation to Title 32 Soldiers and the Air National Guard should have this same level of representation for their Airmen. The benefits of regional ADC offices are: 1) having a separate chain of command avoiding actual or perceived command influence; 2) the ability to handle conflicts of interest in cases with multiple subjects by having immediate access to more than one defense counsel; and 3) greater professional development for JAGs by allowing them to rotate between defense and command-advising positions.
